Clear answers to the questions heirs ask us most often.
As a general rule, six months from the day the inheritance opens - usually the date of death. We recommend contacting us as early as possible so that nothing is missed.
If you have missed the six-month deadline for accepting an inheritance, it does not necessarily mean you have lost your right to inherit.
Depending on the circumstances, the following solutions may be possible.
Actual acceptance of the inheritance. If, within the set period, you began to actually possess or manage property that belonged to the deceased, this may be grounds for considering the inheritance accepted.
With the consent of the other heirs. If you did not actually accept the inheritance, in some cases it can still be accepted after the deadline without going to court, provided that all the other heirs who have accepted the inheritance agree.
By applying to court. If there were valid reasons for missing the deadline, you can apply to the court and ask it to recognize you as having accepted the inheritance.
Important: every case requires an individual assessment. Whether you can still accept the inheritance depends on the facts, the available evidence and the conditions set by law.
If you have missed the deadline, professional advice will help you assess your legal options and choose the right way to resolve the issue.
Depending on the nature of your matter and the specifics of the case, the necessary legal steps, including accepting the inheritance, can also be carried out from abroad, without your personal presence, through a representative.
A certificate of inheritance rights is a document issued, on the heir’s application, by the notary at the place where the inheritance opened, or by an official authorized by law to perform such notarial acts. It allows the heir to properly formalize and exercise their rights to the property in the estate. It is needed:
to register rights to property with the state;
for bank deposits and other property, to receive the property or funds that belonged to the deceased, in the manner established by law.
If a person dies without making a will, their property is inherited by the heirs at law, who are called to inherit in the order of priority established by law.
If the heirs cannot agree on dividing the estate, on who owns particular items of property, or on how to exercise their rights, the dispute can be resolved in court in the manner established by law.
